Allgemeine Geschäftsbedingungen (AGB)

1. Geltungsbereich
Diese AGB gelten für alle Bestellungen und Buchungen über private-chef.ch (Fertiggerichte, Weine und weitere Produkte, Kochkurse sowie Private-Chef-Dienstleistungen) zwischen The Private Chef ® — Marian Podola, Furi 151, 3920 Zermatt (nachfolgend «wir») und unseren Kundinnen und Kunden.
2. Vertragsschluss
Die Darstellung der Produkte im Onlineshop ist eine unverbindliche Einladung zur Bestellung. Mit dem Absenden der Bestellung geben Sie ein verbindliches Angebot ab. Der Vertrag kommt mit unserer Bestellbestätigung per E-Mail oder mit der Lieferung zustande. Wir können Bestellungen ohne Angabe von Gründen ablehnen, insbesondere bei fehlender Verfügbarkeit oder Lieferadressen ausserhalb unseres Liefergebiets.
3. Preise und Zahlung
Alle Preise verstehen sich in Schweizer Franken (CHF) inklusive Mehrwertsteuer. Allfällige Liefergebühren werden im Bestellvorgang vor Abschluss ausgewiesen. Die Zahlung erfolgt über die im Checkout angebotenen Zahlungsmittel und ist vor der Lieferung fällig. Offensichtliche Preis- oder Beschreibungsfehler berechtigen uns zum Rücktritt vom Vertrag; bereits geleistete Zahlungen werden in diesem Fall vollständig erstattet.
4. Lieferung
Lieferung gemäss unseren Lieferbedingungen. Liefergebiet: Zermatt und Täsch. Bestellungen sind mindestens 24 Stunden im Voraus aufzugeben; Lieferungen erfolgen dienstags und donnerstags (Sommersaison 2026). Angegebene Lieferzeiten sind Richtwerte; bei Verzögerungen informieren wir Sie so rasch wie möglich.
5. Lebensmittel
Zutaten, Allergene und Nährwerte sind auf der jeweiligen Produktseite vor dem Kauf ersichtlich. Bitte beachten Sie die Aufbewahrungshinweise und das angegebene Verbrauchsdatum. Gekühlte Produkte sind nach Erhalt umgehend gekühlt zu lagern. Bei Allergien oder Unverträglichkeiten kontaktieren Sie uns vor der Bestellung.
6. Alkohol
Alkoholische Getränke verkaufen wir nur an Personen ab 18 Jahren. Mit der Bestellung bestätigen Sie das Mindestalter; bei der Lieferung kann ein Altersnachweis verlangt werden.
7. Kein gesetzliches Widerrufsrecht
Das schweizerische Recht sieht für Online-Käufe kein gesetzliches Widerrufsrecht vor. Rückgaben und Erstattungen richten sich ausschliesslich nach unserer Rückgabe- und Erstattungsrichtlinie.
8. Kochkurse und Private-Chef-Dienstleistungen
Buchungen werden mit unserer Bestätigung verbindlich. Zur Bestätigung ist eine Anzahlung von 50 % des Preises zu leisten. Bei Annullierung mehr als 48 Stunden vor dem Termin wird die Anzahlung vollständig zurückerstattet; bei Annullierung weniger als 48 Stunden vor dem Termin ist die Anzahlung nicht rückerstattbar. Wir können Termine aus wichtigen Gründen (z. B. Krankheit, höhere Gewalt) verschieben; in diesem Fall bieten wir einen Ersatztermin oder die vollständige Rückerstattung an.
9. Gewährleistung und Mängelrüge
Bitte prüfen Sie die Ware bei Erhalt. Mängel an verderblichen Produkten sind uns innert 24 Stunden nach Lieferung mit Foto an marian@private-chef.ch zu melden; übrige Mängel innert angemessener Frist. Bei berechtigten Beanstandungen leisten wir nach Ihrer Wahl Ersatz oder erstatten den Kaufpreis. Die gesetzlichen Gewährleistungsrechte bleiben gewahrt.
10. Haftung
Soweit gesetzlich zulässig, haften wir nur für Schäden, die wir vorsätzlich oder grobfahrlässig verursacht haben. Die zwingende gesetzliche Haftung — namentlich für Personenschäden und nach Produktehaftpflichtgesetz — bleibt unberührt.
11. Geistiges Eigentum
Alle Inhalte dieser Website (Texte, Bilder, Rezepte, Logos) sind urheberrechtlich geschützt und dürfen ohne unsere schriftliche Zustimmung nicht für kommerzielle Zwecke verwendet werden.
12. Anwendbares Recht und Gerichtsstand
Es gilt schweizerisches Recht. Gerichtsstand ist Zermatt (Bezirk Visp), soweit nicht zwingende gesetzliche Gerichtsstände — insbesondere für Konsumentinnen und Konsumenten — etwas anderes vorsehen.
13. Änderungen
Wir können diese AGB jederzeit anpassen. Für Bestellungen gilt die zum Zeitpunkt der Bestellung publizierte Fassung.

Terms of Service

1. Scope
These terms apply to all orders and bookings via private-chef.ch (ready meals, wines and other products, cooking classes and private chef services) between The Private Chef ® — Marian Podola, Furi 151, 3920 Zermatt, Switzerland (“we”, “us”) and our customers.
2. Conclusion of contract
Products shown in the online shop are a non-binding invitation to order. By submitting an order you make a binding offer. The contract is concluded when we confirm your order by email or deliver the goods. We may decline orders without giving reasons, in particular where items are unavailable or the delivery address is outside our delivery area.
3. Prices and payment
All prices are in Swiss francs (CHF) and include VAT. Any delivery fees are shown at checkout before you complete your order. Payment is made via the methods offered at checkout and is due before delivery. Obvious pricing or description errors entitle us to withdraw from the contract; in that case any payment made is refunded in full.
4. Delivery
Delivery is governed by our delivery policy. Delivery area: Zermatt and Täsch. Orders must be placed at least 24 hours in advance; deliveries are made on Tuesdays and Thursdays (summer 2026 season). Delivery times are estimates; we will inform you promptly of any delay.
5. Food
Ingredients, allergens and nutrition information are shown on each product page before purchase. Please follow the storage instructions and the use-by date stated on the product. Chilled products must be refrigerated promptly after receipt. If you have allergies or intolerances, contact us before ordering.
6. Alcohol
We sell alcoholic beverages only to persons aged 18 or over. By ordering you confirm you meet the minimum age; proof of age may be requested on delivery.
7. No statutory right of withdrawal
Swiss law does not provide a statutory right of withdrawal for online purchases. Returns and refunds are governed exclusively by our refund policy.
8. Cooking classes and private chef services
Bookings become binding upon our confirmation. A deposit of 50% of the price is required to confirm a booking. If cancelled more than 48 hours before the date, the deposit is refunded in full; if cancelled less than 48 hours before, the deposit is non-refundable. We may reschedule for good cause (e.g. illness, force majeure); in that case we offer an alternative date or a full refund.
9. Warranty and notice of defects
Please inspect the goods on receipt. Defects in perishable products must be reported to marian@private-chef.ch within 24 hours of delivery, with a photo; other defects within a reasonable period. For justified complaints we will, at your option, replace the goods or refund the purchase price. Your statutory warranty rights remain unaffected.
10. Liability
To the extent permitted by law, we are liable only for damage caused intentionally or by gross negligence. Mandatory statutory liability — in particular for personal injury and under the Swiss Product Liability Act — remains unaffected.
11. Intellectual property
All content on this website (texts, images, recipes, logos) is protected by copyright and may not be used for commercial purposes without our written consent.
12. Governing law and jurisdiction
Swiss law applies. The place of jurisdiction is Zermatt (district of Visp), unless mandatory statutory venues — in particular for consumers — provide otherwise.
13. Changes
We may amend these terms at any time. The version published at the time of your order applies to that order.

When you place an order, you are making an offer to purchase. The Private Chef reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until The Private Chef confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as The Private Chef may be unable to accommodate cancellation requests after an order is accepted. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the e‑mail, billing address, and/or phone number provided at the time the order was made.
Your purchases are subject to return or exchange solely in accordance with our Refund Policy [LINK].
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.
SECTION 4 - PRICES AND BILLING
Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs or import charges.

You represent and warrant that (i) the credit card information you provide is true, correct, and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any.
SECTION 5 - SHIPPING AND DELIVERY
We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer products to the carrier, title and risk of loss passes to you.

Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by The Private Chef, its affiliates or licensors and are protected by U.S. and foreign patent, copyright and other intellectual property laws.

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL The Private Chef, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY.
SECTION 17 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless The Private Chef, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys’ fees, payable to any third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.
We will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You will cooperate in the defense of indemnified claims, including by providing relevant documents.
SECTION 18 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 19 - WAIVER; ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
