Payment & Cancellation Policy
(Applicable to all private dining, catering, and culinary service engagements)
1. Booking and Deposit
1.1 A booking is considered confirmed only upon receipt of a 50% deposit of the total quoted value.
1.2 The deposit must be paid immediately upon written acceptance of the offer to secure the requested date and services.
1.3 The remaining 50% balance is due no later than 7 (seven) calendar days prior to the scheduled service date, unless otherwise agreed in writing.
1.4 Payments shall be made by bank transfer to the account indicated on the invoice. All prices are quoted in Swiss Francs (CHF) and are inclusive of Swiss VAT (Mehrwertsteuer / TVA).
2. Additional Services and Adjustments
2.1 Any additional services requested during the performance of the booking — such as extended hours, additional courses, staff, beverages, or materials — shall be re-invoiced upon completion of the event.
2.2 These supplementary costs must be settled within 7 days of the final invoice date.
3. Cancellation Terms
Due to the bespoke nature of private dining and the preparation work required in advance, the following cancellation fees apply in accordance with Art. 377 and Art. 404 of the Swiss Code of Obligations (OR) and established Swiss commercial practice:

3.1 The percentages above apply to the total confirmed booking value (including food, labour, and logistics).
3.2 In cases where the client cancels after full payment has been made, the refundable amount (if any) will be returned within 14 days after written notice of cancellation.
4. Extraordinary Circumstances
4.1 Should an extraordinary or unavoidable circumstance arise — such as natural disaster, severe illness (certified), or government restriction (e.g., health or travel ban) — each case will be individually assessed in good faith.
4.2 In such cases, the parties may agree to reschedule the event without penalty, or, if rescheduling is not possible, a partial refund may be granted at the discretion of The Private Chef – Marian Podola.
4.3 Any such decision shall be consistent with Art. 119 OR (Impossibility of Performance) and Art. 97 ff. OR (Breach of Contract), applying principles of fairness and mitigation of damages.
5. Chef’s Cancellation or Force Majeure
5.1 In the unlikely event that The Private Chef – Marian Podola must cancel a confirmed event due to illness, accident, or force majeure, all payments received will be refunded in full.
5.2 No further financial or consequential claims shall arise beyond the refund of amounts paid.
6. Governing Law and Jurisdiction
6.1 This agreement and all related transactions are governed by the laws of Switzerland (Schweizerisches Obligationenrecht – OR).
6.2 The exclusive place of jurisdiction for any disputes arising under this policy or related agreements shall be Visp (Canton of Valais), Switzerland, unless otherwise required by mandatory consumer protection laws.
7. Acceptance
By confirming a booking and/or making payment, the client acknowledges and accepts the above Payment & Cancellation Policy in full.
